Anything short of structural separation will be circumvented by operators who have deep pockets. They will file lawsuits, influence regulators disproportionately and play funny games."

Yep, this is what I've been saying all along. Instead of "Net Neutrality" which can be gamed by deep pocketed incumbents, we need to ressurect Judge Green and split up the Incumbents, but this time the right way. Horizontally. The physical plant becomes a regulated monopoly and just does open access transport and collocation. The upper part (services) has to compete with everyone else on an equal footing.
